  • Auto Glass Industry Petition

In an earlier post I suggested running an epetition. The epetition could be posted and emailed and referred to in direct mail ads etc.
Once enough signatures are received, they could be forwarded to the FTC, State dept of Ins., Attorney Generals, Insurance companies etc.
Here is a rough draft but initially anyone could submit their on "whereas" and Therefores and then put into a final draft:

Auto Glass Industry National Right to Fair Trade Petition

Whereas: Federal and State Laws espouse a Fair and Free Trade Philosophy.

Whereas: Fair and Free Trade espouses competition and restricts anti-competitive
    Activity.

Whereas: United States Businesses have a reasonable expectation to maintain customer
names, addresses, phone numbers, email addresses, prices, as well as other
business transaction information as confidential and proprietary.

Whereas: United States Businesses have a reasonable expectation to negotiate
    their own prices and relationships.

Whereas: United States Businesses have a reasonable expectation from being forced to
transact business with and divulge confidential and proprietary business
    information to competitors.

Whereas: Consumers have a reasonable expectation of freedom of choice when making
business decisions and selecting auto glass repair facilities without being
subjected to coercion, innuendo, or favoritism.

Whereas: Consumers have a reasonable expectation to privacy and to not have their
private business transaction information released to uninterested parties.

Whereas: Consumers should not be forced to deal with businesses in competition with
    their vendor of choice.

And Whereas: Auto glass windshields are an integral component of the automotive
    consumer safety restraint system.

Therefore: I urge you in the strongest possible way to restore the above mentioned tenets to the auto glass industry by enforcing existing laws and, if necessary, by adopting legislation that forbids violation of any of the above positions, especially the use of biased third party auto glass claims administrators, i.e. substantially and/or financially related to auto glass repair and replacement facilities which is an obvious conflict of interest.

Furthermore, the use of pricing agreements with no allowance for negotiation as a condition for being listed as a potential service provider or “preferred” service provider should be disallowed because service providers are then coerced into signing agreements which have not been negotiated simply to be listed as potential vendors or “preferred” vendors and/or to keep from being referred to as “not on the list of preferred providers”.

      Glass repair firms cry foul
Insurers defend deal that some say hurts local businesses
By Karen Bouffard Detroit News Lansing Bureau Lansing— An Ohio-based company that processes auto glass claims for Michigan insurers is steering business to its own glass repair shops, critics charge — a practice they say robs customers of choice and is forcing Michigan businesses to close. Customers who call for glass repair approval from Allstate, Farmers, AAA and scores of other Michigan insurers are connected to Safelite Solutions' phone lines, a company hired as a third-party administrator to book repairs and process claims. Safelite also owns Safelite AutoGlass, one of the largest auto glass repair provi...

Negotiating Claims: Refuse to Do It

Collision business owners are routinely and institutionally told by insurers that they must negotiate with them to an agreed price on repairs on property they don't own, even though they have no legal standing or credentials to do so.

      By Mike Orton
      9/30/2011
The Missouri Attorney General recently launched an investigation of contractors who offer to represent homeowners in negotiations with insurance companies with regard to storm damage losses. I’m delighted to see that our commissioner of insurance has made it abundantly clear that parties outside the contract of insurance cannot negotiate insurance claims.

      Three Options
Just like auto policies, homeowners’ policies are known as cash value policies, where the insurer has t...

    • Let's talk ARBITRATION
      vglass
It has not been safe to talk about Arbitration any where else, and NOW this might be the right place. I cannot talk about any specifics, of who or what, but we can talk about, why and how. How many shops have experienced short pays? Maybe thousands? Now how many have had a viable tool to collect those short pays? The very first consideration is, if you are on contract with any tpa who services a certain ins co, and are short paid, you may not have a leg to stand on, because you are at the mercy of that tpa via your contract. Those shops need not respond, because you are not part of the solutio...

    • IGA Announces Relaunch of Electronic Standards Effort
      Administrator
The Independent Glass Associa9on (IGA), a trade organization representing the business interests of independently owned auto glass repair and replacement shops across North America, introduced the industry to the concept of technology standards on February 11th of this year. Response from the industry was immediate and incredibly supportive. Unfortunately, the effort was impaired by a need for a change in management. “We were primed and ready to make a difference in the industry,” said Alan Epley, owner of Southern Glass and Plastics and current IGA President. “We realized, however, that IGA needed to make a change at the top to better ...
